Appendix D: Powers of the Minister to give directions to ASADA
Under Section 24 of the ASADA Act, the Minister can give ASADA the following directions:
24 Minister may give directions to ASADA
- The Minister may, by legislative instrument, give directions to the ASADA in relation to the performance of its functions and the exercise of its powers.
Note: For variation and revocation, see subsection 33(3) of the Acts Interpretation Act 1901. - However, such a direction must not relate to:
- a particular athlete, or a particular support person, who is subject to the NAD scheme, or
- the testing of a particular athlete under an anti-doping testing service, or safety checking service, being provided by the ASADA.
- The ASADA must comply with a direction under subsection(1).
